    (דברים כב כג) כִּי יִהְיֶה נַעֲרָה בְתוּלָה מְאֹרָשָׂה לְאִישׁ – מְלַמֵּד שֶׁאֵינוֹ חַיָּב עַד שֶׁתְּהֵא נַעֲרָה בְתוּלָה מְאֹרָשָׂה לְאִישׁ.

    (Devarim 22:23) "If there be a na'arah, a virgin, betrothed": We are hereby taught that he is not liable (to stoning) unless she be a na'arah (and not a bogereth [viz. #238]), a virgin, and betrothed to a man (and not married).

    וּמְצָאָהּ אִישׁ בָּעִיר, אִלּוּ לֹא יָצָאת בָּעִיר לֹא הָיָה מִסְתַּקֵּף לָהּ.

    "and a man find her in the city": If she had not gone about in the city, this would not have befallen her

    בָּעִיר וְשָׁכַב עִמָּהּ, מְלַמֵּד שֶׁהַפִּרְצָה קוֹרְאָה לַגַּנָּב.

    — "The breach beckons to the thief." "and lie with her": any kind of intercourse (natural or unnatural).

    וְהוֹצֵאתֶם אֶת שְׁנֵיהֶם אֶל שַׁעַר הָעִיר הַהִוא, זוֹ הִיא שֶׁאָמַרְנוּ שַׁעַר שֶׁנִּמְצְאוּ בוֹ וְלֹא שַׁעַר שֶׁנִּדּוֹנוּ בוֹ.

    (Ibid. 24) "Then you shall take out both of them to the gate of that city": to the gate where she was found and not to the gate where she was judged.

    וּסְקַלְתֶּם אֹתָם בָּאֲבָנִים, יָכוֹל בָּאֲבָנִים מְרֻבּוֹת? תַּלְמוּד לוֹמַר (ויקרא כ כז): ״בָּאֶבֶן״. אִי ״בָּאֶבֶן״, יָכוֹל אֲפִלּוּ בְּאֶבֶן אַחַת? תַּלְמוּד לוֹמַר: בָּאֲבָנִים. אֱמֹר מֵעַתָּה: אִם לֹא מֵתוּ בָּרִאשׁוֹנָה, יָמוּתוּ בַּשְּׁנִיָּה.

    "and you shall stone them with stones": I might think with many stones; it is, therefore, written (Vayikra 20:27) "with a stone." If "with a stone," I might think even with one stone. It is, therefore, written "with stones." Say, then (that the meaning is) if they do not die with the first stone, they die with the second.

    אֶת הַנַּעֲרָה עַל דְּבַר אֲשֶׁר לֹא צָעֲקָה. כְּשֶׁהוּא אוֹמֵר עַל דְּבַר עַל פִּי הַתְרָאָה, לְהָבִיא אֶת הַמְּזִידָה בְּהַתְרָיַת עֵדִים.

    "the maiden because (lit., "by word of") she did not cry out": What is the intent of "by word of": to include her who transgressed willfully as requiring (for stoning) the forewarning of witnesses (i.e., because of her violation of the word of warning).

    וְאֶת הָאִישׁ עַל דְּבַר אֲשֶׁר עִנָּה אֶת אֵשֶׁת רֵעֵהוּ, כְּשֶׁהוּא אוֹמֵר עַל דְּבַר – עַל פִּי הַתְרָיָה.

    "and the man, because (i.e., "by word of") he afflicted his neighbor's wife": What is the intent of "by word of"? By forewarning.

    (דברים כב כה) אֵין לִי אֶלָּא בָּעִיר, בַּשָּׂדֶה מִנַּיִן? תַּלְמוּד לוֹמַר (דברים כב כה): וְאִם בַּשָּׂדֶה יִמְצָא הָאִישׁ.

    וְשָׁכַב עִמָּהּ, פְּרָט לְשֶׁאֶחָד מַחֲזִיק וְאֶחָד שׁוֹכֵב, דִּבְרֵי רַבִּי יְהוּדָה.

    (Ibid. 25) "And if in the field the man find the betrothed maiden and lie with her": to exclude an instance where one holds her and the other lies with her, (in which instance there is no death penalty.) These are the words of R. Yehudah.

    וּמֵת הָאִישׁ אֲשֶׁר שָׁכַב עִמָּהּ לְבַדּוֹ, הָרִאשׁוֹן בִּסְקִילָה וְהַשֵּׁנִי בְּחֶנֶק.

    "then the man who lay with her shall be put to death (by stoning) alone: the first, by stoning, (because he violated a virgin); the second, (if there is one,) by strangulation. These are the words of Rebbi.
